London, 2 October 2026: The Sikh Federation (UK) has urged the UK government to formally grant Diplomatic Protection to British citizen Jagtar Singh Johal without further delay.

ਡੰਬਾਰਟਨ ਦੇ ਰਹਿਣ ਵਾਲੇ ਜਗਤਾਰ ਸਿੰਘ ਜੌਹਲ ਲਗਭਗ ਨੌਂ ਸਾਲ ਹਿਰਾਸਤ ਵਿੱਚ ਰਹਿਣ ਮਗਰੋਂ 1 ਅਕਤੂਬਰ ਨੂੰ ਭਾਰਤ ਵਿੱਚ ਜੇਲ੍ਹ ਤੋਂ ਰਿਹਾਅ ਹੋਏ। ਮਨੁੱਖੀ ਅਧਿਕਾਰ ਸੰਸਥਾ ਰਿਪਰੀਵ ਨੇ ਇਸ ਦਾ ਸਵਾਗਤ ਕਰਦਿਆਂ ਕਿਹਾ ਕਿ ਉਨ੍ਹਾਂ ਖ਼ਿਲਾਫ਼ ਅਦਾਲਤੀ ਕਾਰਵਾਈਆਂ ਅਜੇ ਜਾਰੀ ਹਨ, ਜਿਨ੍ਹਾਂ ਵਿੱਚ ਦੋਸ਼ ਸਾਬਤ ਹੋਣ ਉੱਤੇ ਮੌਤ ਦੀ ਸਜ਼ਾ ਹੋ ਸਕਦੀ ਹੈ। ਉਨ੍ਹਾਂ ਦੀ ਆਵਾਜਾਈ, ਲੋਕਾਂ ਨਾਲ ਮਿਲਣ ਅਤੇ ਜਨਤਕ ਤੌਰ ਉੱਤੇ ਬੋਲਣ ਉੱਤੇ ਵੀ ਸਖ਼ਤ ਪਾਬੰਦੀਆਂ ਹਨ।

ਬਰਤਾਨੀਆ ਵੱਲੋਂ ਹੋਰ ਮਜ਼ਬੂਤ ਕੂਟਨੀਤਕ ਕਾਰਵਾਈ ਦੀ ਮੰਗ ਨੂੰ ਸੰਸਦੀ ਸਮਰਥਨ ਵੀ ਮਿਲਿਆ ਹੈ। ਜੁਲਾਈ 2025 ਵਿੱਚ ਪੇਸ਼ ਕੀਤੇ ਇੱਕ ਸੰਸਦੀ ਮਤੇ ਨੇ ਲਗਾਤਾਰ ਬਰਤਾਨਵੀ ਸਰਕਾਰਾਂ ਵੱਲੋਂ ਪ੍ਰਭਾਵਸ਼ਾਲੀ ਕੂਟਨੀਤਕ ਸੁਰੱਖਿਆ ਨਾ ਦਿੱਤੇ ਜਾਣ ਦੀ ਆਲੋਚਨਾ ਕੀਤੀ ਸੀ ਅਤੇ ਜੌਹਲ ਦੀ ਰਿਹਾਈ ਤੇ ਸੁਰੱਖਿਅਤ ਵਾਪਸੀ ਲਈ ਉੱਚ ਪੱਧਰੀ ਗੱਲਬਾਤ ਦੀ ਮੰਗ ਕੀਤੀ ਸੀ। ਇਹ ਮਤਾ ਉਨ੍ਹਾਂ ਦੀ ਜ਼ਮਾਨਤ ਉੱਤੇ ਰਿਹਾਈ ਤੋਂ ਪਹਿਲਾਂ ਦਾ ਹੈ।

The UK Government should urgently consider granting diplomatic protection to British Sikh national Jagtar Singh Johal and intensify efforts to secure his safe return to Scotland. His release on bail is a significant development, but the restrictions and outstanding proceedings mean his case remains unresolved.

Johal, from Dumbarton, was released from prison in India on 1 October after almost nine years in custody. Human rights organisation Reprieve welcomed the development while stressing that he continues to face criminal proceedings, potentially carrying the death penalty, and strict restrictions on his movement, association and public speech.

The call for stronger British diplomatic action has parliamentary backing. An early day motion tabled in July 2025 criticised the lack of effective diplomatic protection provided by successive UK governments and urged high-level engagement to secure Johal’s release and safe return. According to REDRESS, the UN Working Group on Arbitrary Detention subsequently found that his detention lacked a legal basis, was arbitrary and involved torture. Following his release, Reprieve representative Dan Dolan and West Dunbartonshire MP Douglas McAllister called for negotiations with India to bring him home. Campaigners say his passport has been surrendered and his bail conditions prevent him from leaving India. Indian authorities have previously denied allegations of torture and maintained that due process is being followed.

According to the organisation, Johal’s case should not be treated as a routine consular matter. It said that if the UK invokes Diplomatic Protection, the case would be elevated into a formal state-to-state legal dispute between Britain and India.

The Sikh Federation (UK) said such a step would amount to the UK formally recognising Johal’s allegations, including claims that his initial confession was extracted under torture, as an injury to the British state itself. It added that this could provide the UK government with a legal basis to pursue formal remedies against India under international law.

The organisation also referred to the case of Nazanin Zaghari-Ratcliffe, stating that the UK government granted Diplomatic Protection to her in 2019 while she was detained in Iran.

Dabinderjit Singh OBE, Chief Executive for Political Engagement at Sikh Federation (UK), said confidential information had already been provided to the UK government regarding risks to Johal’s safety.

“We have provided confidential information to the UK government, including risks to Jagtar’s safety that provides strong grounds to grant Diplomatic Protection,” he said.

The Sikh Federation (UK) further said there was cross-party political support for efforts to bring Johal back to the UK and argued that the government already had the necessary means to act.

The organisation said the issue was now whether the UK government had the political will to take that step.
